1. Introduction
Welcome to PIXADO. These Terms of Service ("Terms") govern your access to and use of the PIXADO website ( pixado.ai ), our AI Studio ( app.pixado.ai ), our APIs, and any related services (collectively, the "Service"), operated by PIXADO ("we", "us", or "our").
By creating an account, subscribing to a plan, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.
2. Eligibility
You must be at least 16 years old to use the Service. By using PIXADO, you represent that:
- You are at least 16 years of age (or the age of digital consent in your jurisdiction).
- You have the legal capacity to enter into a binding contract.
- You are not barred from using the Service under applicable law.
3. Account Registration
To access most features, you must create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your password and for any activity under your account. Notify us immediately at contact@pixado.ai if you suspect unauthorized access.
4. Subscription Plans & Billing
4.1 Plans
PIXADO offers paid subscription plans (e.g., Creator Pro, Studio Agency). Each plan has features and usage limits described on our Pricing page.
4.2 Payment
Payments are processed by Stripe. By subscribing, you authorize us to charge your chosen payment method on a recurring basis (monthly or annual) until you cancel. All prices are in USD unless otherwise stated and exclude applicable taxes (VAT, sales tax) which may be added at checkout.
4.3 Renewal & Cancellation
Subscriptions renew automatically at the end of each billing period. You may cancel anytime from your account dashboard. Cancellation takes effect at the end of the current billing period — you keep access until then.
4.4 Refunds
Refunds are governed by our Refund Policy. In general, we operate a no-refund policy once a billing period has started, as you have full access to digital content.
5. Acceptable Use
You agree not to:
- Use the Service to create content that is illegal, defamatory, hateful, or violates third-party rights (including intellectual property, privacy, or publicity rights).
- Attempt to reverse-engineer, decompile, or extract our AI models.
- Use automated tools (bots, scrapers) to access the Service without our written permission.
- Resell, sublicense, or redistribute access to your account.
- Upload malicious code, conduct denial-of-service attacks, or interfere with the Service.
- Generate content depicting real people in misleading or non-consensual contexts.
- Generate content involving minors in any sexual, exploitative, or harmful manner.
We reserve the right to suspend or terminate accounts that violate these rules, without refund.
6. Content & Intellectual Property
6.1 Your Content
You retain ownership of any images, prompts, faces, or videos you upload ("Your Content"). By uploading, you grant PIXADO a worldwide, non-exclusive, royalty-free license to host, process, analyze, and display Your Content solely to operate the Service.
6.2 Generated Output
Subject to compliance with these Terms, you own the thumbnails and derivatives generated for you ("Generated Output"), and you may use them commercially. We make no warranty that Generated Output is unique or non-infringing.
6.3 Our IP
The PIXADO platform, software, models, brand, and ThumbScore™ trademark are owned by us. You may not use our marks without prior written consent.
7. AI Disclaimers
Our Service relies on machine learning models. Outputs may contain inaccuracies, biases, or unexpected results. We do not guarantee a specific click-through rate (CTR), view count, or revenue outcome. Performance examples on our website are illustrative.
8. Limitation of Liability
To the maximum extent permitted by law, PIXADO shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total aggregate liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
9. Termination
We may suspend or terminate your access at any time for breach of these Terms or non-payment. You may close your account at any time. Upon termination, your right to use the Service ceases immediately, and we may delete your data after a 30-day grace period.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified by email or via a banner on our website at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Any dispute shall be brought before the competent courts of the judicial district of Montréal, Québec, unless mandatory consumer protection law of your country of residence provides otherwise.
